  1. My understanding of the music issue is that it would only be possible to obtain a kind of blanket license to play music in more of a streaming capacity – not where you can download MP3s to keep. I believe it took an act of congress to set up the system to play whatever music you like on a radio station and pay one (or several) standardized fees. But no such law exists for “mechanical reproduction” – so in theory you would need to negotiate with the record labels / copyright holders separately for each and every song. Also, remember that with commercial music, you have to pay both the copyright holder AND the songwriter (via ASCAP, BMI, etc.). Creative Commons waives both these things, when such music is used under the terms of the CC license.

    Bottom line – there s no realistic way to include commercial music in podcasts (beyond the limited and vague scope of fair use). It would be possible to set up a streaming station to play music on – but I know they have increased the rates recently and there is probably a lot of paperwork and red tape to deal with.
