Released October 2010 on The Overnightscape Underground (onsug.com), an Internet talk radio channel focusing on a freeform monologue style, with diverse and fascinating hosts presenting amazingly unique programs that are safe and effective.
My interpretation of the Creative Commons “non-commercial” clause as relates to advertisements:
The creator of the show (and owner of the copyright) applies the CC license to their work to grant certain rights to other people. In this case, the copyright holder is granting all of us the right to redistribute the work in a non-commercial way.
However, the creator of the show is not under these restrictions – they have full rights, including making money off the podcast.
So, the creator can graft an advertisement inside the show and make money off it. However, the CC license states that anyone else cannot make money off the show.
I would hope however that the show creator got the advertiser’s permission to allow for endless redistribution of their ad, which they may own the copyright to.
And if such a show is being redistributed I think it would be good to state that as a re-distributor you are not making any money off the ad.
It’s a shame things need to be this convulted – but this is a weird transitional time, so perhaps it is to be expected.

thanks, i figured it was something like that. i think it comes down to that i am far less inclined to re-distribute things that endorse places/products/etc that i have no idea about…
